Selected legal aspects of sedation

Sedation may cause a number of legal doubts. This procedure has not yet been regulated in Poland. Particularly, one question arises, as for who can decide on its use and end, especially if the consequence of such omission may be the patient’s death.

This article considers legal regulations, which may be used to resolve such dilemmas. Therefore, the issue of sedation in the context of the patient’s right to respect dignity, including passing away in peace, has been considered. Requirements regarding the patient’s consent to such proceedings have also been deliberated, as well as instances when the patient – due to his condition – cannot express his explicit, legally effective statement. The subject matter of criminal responsibility for causing consequence to the life and health of the patient, which may occur as a result of increasing doses of pain-relieving medications was presented.
